Terms of service
Article 1 (Purpose)
The purpose of these Terms is to set forth the rights, obligations, and responsibilities of Fixed Gear Seoul (the "Mall," an electronic commerce operator) and its Users in connection with the Mall's use of the internet-related services (the "Services") provided through the Fixed Gear Seoul cyber mall (the "Mall").
※ These Terms apply, to the extent not inconsistent with their nature, to electronic commerce conducted via PC communications, wireless means, and similar channels.
Article 2 (Definitions)
① "Mall" means the virtual place of business that Fixed Gear Seoul establishes using computers and other information and communications facilities in order to enable the trading of Goods or Services (collectively, "Goods, etc.") with Users; the term is also used to refer to the business operator running the cyber mall.
② "User" means a Member or non-Member who accesses the Mall and receives Services provided by the Mall under these Terms.
③ "Member" means a person who has registered as a member with the Mall and may continuously use the Services the Mall provides.
④ "Non-Member" means a person who uses the Services provided by the Mall without registering as a Member.
Article 3 (Disclosure, Explanation, and Amendment of the Terms)
① The Mall shall post the content of these Terms, along with its trade name, the name of its representative, the address of its place of business (including an address where consumer complaints can be handled), telephone number, fax number, e-mail address, business registration number, mail-order sales registration number, and the name of its personal information protection officer, on the initial service screen (front page) of the Fixed Gear Seoul cyber mall so that Users can easily see them. However, the content of the Terms may be made accessible to Users through a linked screen.
② Before a User agrees to these Terms, the Mall shall provide a separate linked screen or pop-up screen so the User can understand and confirm important matters set out in the Terms — such as withdrawal of subscription, delivery responsibility, and refund conditions.
③ The Mall may amend these Terms to the extent such amendment does not violate the Act on the Consumer Protection in Electronic Commerce, Etc., the Act on the Regulation of Terms and Conditions, the Framework Act on Electronic Documents and Electronic Transactions, the Electronic Financial Transactions Act, the Digital Signature Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, Etc., the Door-to-Door Sales, Etc. Act, the Framework Act on Consumers, and other relevant laws.
④ If the Mall amends these Terms, it will specify the effective date and the reason for the amendment and give notice, together with the current Terms, on the Mall's initial screen from 7 days before the effective date until the day before the effective date. However, if the amendment is disadvantageous to Users, the Mall will give notice with at least 30 days' advance notice. In such a case, the Mall will clearly display a comparison between the content before and after the amendment so Users can easily understand it.
⑤ Where the Mall amends these Terms, the amended Terms apply only to contracts concluded on or after the effective date; contracts concluded before that date remain governed by the Terms in effect prior to the amendment. However, if a User who has already concluded a contract wishes to be governed by the amended Terms and communicates that intent to the Mall within the notice period under paragraph 3 and obtains the Mall's consent, the amended Terms will apply.
⑥ Matters not specified in these Terms and the interpretation of these Terms shall be governed by the Act on the Consumer Protection in Electronic Commerce, Etc., the Act on the Regulation of Terms and Conditions, the Consumer Protection Guidelines in Electronic Commerce, Etc. established by the Fair Trade Commission, other relevant statutes, and commercial custom.
Article 4 (Provision and Change of Services)
① The Mall performs the following functions:
- Providing information on Goods or Services and concluding purchase contracts
- Delivering Goods or Services for which a purchase contract has been concluded
- Other functions determined by the Mall
② If Goods or Services are out of stock or their technical specifications change, the Mall may change the content of the Goods or Services to be provided under contracts to be concluded in the future. In such a case, the Mall will immediately give notice, specifying the changed content and the date of provision, at the location where the current Goods or Services information is posted.
③ If the content of a Service that the Mall has contracted to provide to a User changes due to the Goods, etc. being out of stock or a change in technical specifications, the Mall will immediately notify the User of the reason, at an address where the User can be notified.
④ In the case of the preceding paragraph, the Mall shall compensate the User for any resulting damage, unless the Mall proves that it was not intentional or negligent.
Article 5 (Suspension of Services)
① The Mall may temporarily suspend provision of the Services in the event of maintenance, inspection, replacement, or breakdown of computers or other information and communications facilities, or a communications outage.
② The Mall shall compensate Users or third parties for damage arising from a temporary suspension of Services under paragraph 1, unless the Mall proves that it was not intentional or negligent.
③ If the Mall becomes unable to provide the Services due to a change of business line, abandonment of business, merger between companies, or similar reason, the Mall shall notify Users in the manner set out in Article 8 and compensate consumers under the terms the Mall previously announced. If the Mall has not announced compensation standards, it shall pay Users the cash value, or an equivalent in kind, of any mileage or accumulated points based on the currency value used within the Mall.
Article 6 (Membership Registration)
① A User applies for membership by completing the membership information in the form prescribed by the Mall and indicating agreement with these Terms.
② The Mall shall register as a Member any User who applies under paragraph 1, unless the applicant falls under one of the following:
- The applicant previously lost membership status under Article 7, paragraph 3 — except where more than three years have passed since the loss of membership status under Article 7, paragraph 3, and the Mall has approved the applicant's re-registration.
- The registration contains false information, omissions, or errors.
- The Mall determines that registering the applicant as a Member would pose a significant technical difficulty.
③ A membership agreement is formed at the time the Mall's acceptance reaches the Member.
④ If there is a change to any information a Member registered at the time of joining, the Member must notify the Mall of the change, such as by updating their member information, within a reasonable time.
Article 7 (Withdrawal of Membership and Loss of Membership Status)
① A Member may request to withdraw from the Mall at any time, and the Mall shall process the withdrawal immediately.
② The Mall may restrict or suspend a Member's status if the Member:
- registered false information when applying for membership;
- fails to pay, by the due date, charges for Goods, etc. purchased through the Mall or other debts owed in connection with use of the Mall;
- interferes with another person's use of the Mall or misappropriates their information, thereby threatening the order of electronic commerce; or
- uses the Mall to engage in conduct prohibited by law or these Terms, or contrary to public order and morals.
③ If, after the Mall has restricted or suspended a Member's status, the same conduct is repeated two or more times, or the grounds are not corrected within 30 days, the Mall may terminate the Member's status.
④ Where the Mall terminates a Member's status, it will cancel the Member's registration. In such a case, the Mall will notify the Member and, before cancelling the registration, allow the Member an opportunity to explain, setting a period of at least 30 days.
Article 8 (Notices to Members)
① The Mall may give notice to a Member at the e-mail address the Member has designated in advance by agreement with the Mall.
② For notices to an unspecified number of Members, the Mall may substitute individual notice by posting on the Mall's bulletin board for at least one week. However, matters that materially affect a Member's own transaction will be individually notified.
Article 9 (Purchase Application)
① A User of the Mall applies to purchase Goods, etc. on the Mall by the following or a similar method, and the Mall shall present each of the following items in a manner easy for the User to understand when the User applies to purchase:
- Searching for and selecting Goods, etc.
- Entering the recipient's name, address, telephone number, e-mail address (or mobile phone number), etc.
- Confirming the content of the Terms, any Services for which the right of withdrawal is restricted, and matters related to the bearing of costs such as delivery fees and installation fees
- An indication (e.g., a mouse click) agreeing to these Terms and confirming or declining item 3 above
- An application to purchase Goods, etc., and agreement to the confirmation of the application or the Mall's confirmation
- Selection of a payment method
② Where the Mall needs to provide or entrust a purchaser's personal information to a third party, it must obtain the purchaser's consent at the time of the actual purchase application, and may not obtain blanket advance consent at the time of membership registration. In doing so, the Mall must specify to the purchaser the items of personal information provided, the recipient, and the recipient's purpose and period of use and retention of the personal information. However, where other statutes provide otherwise — such as entrustment of personal information processing under Article 25, paragraph 1 of the Act on Promotion of Information and Communications Network Utilization and Information Protection, Etc. — those statutes govern.
Article 10 (Formation of Contract)
① The Mall may decline to accept a purchase application under Article 9 if any of the following applies. However, if concluding a contract with a minor, the Mall must give notice that the contract may be cancelled by the minor or the minor's legal representative if the legal representative's consent has not been obtained.
- The application contains false information, omissions, or errors.
- A minor is purchasing tobacco, alcohol, or other Goods or Services prohibited under the Juvenile Protection Act.
- The Mall determines that accepting the purchase application would pose a significant technical difficulty.
② A contract is deemed formed at the time the Mall's acceptance, in the form of the confirmation-of-receipt notice under Article 12, paragraph 1, reaches the User.
③ The Mall's expression of acceptance must include information such as confirmation of the User's purchase application, availability for sale, and correction or cancellation of the purchase application.
Article 11 (Method of Payment)
Payment for Goods or Services purchased on the Mall may be made by any available method among the following. However, the Mall may not add any fee, under any name, to the price of Goods, etc. in connection with the User's chosen payment method.
- Various forms of account transfer, including phone banking, internet banking, and mail banking
- Various card payments, including prepaid cards, debit cards, and credit cards
- Online bankbook (non-face-to-face) deposit
- Payment by electronic money
- Cash on delivery
- Payment using points such as mileage issued by the Mall
- Payment using a gift certificate that the Mall has contracted for or recognizes
- Payment by other electronic means
Article 12 (Confirmation-of-Receipt Notice; Change and Cancellation of Purchase Application)
① The Mall shall send a confirmation-of-receipt notice to a User upon receiving the User's purchase application.
② A User who receives a confirmation-of-receipt notice may, if there is a discrepancy in intent, immediately request a change or cancellation of the purchase application upon receiving that notice, and the Mall shall process such a request without delay if made before dispatch. However, if payment has already been made, the provisions on withdrawal of subscription, etc. under Article 15 apply.
Article 13 (Supply of Goods, etc.)
① Unless otherwise agreed with the User regarding the timing of supply of Goods, etc., the Mall shall take the necessary measures — such as producing to order, packaging, etc. — so that Goods, etc. can be delivered within 7 days from the date the User made the offer to purchase. However, if the Mall has already received full or partial payment for the Goods, etc., it shall take such measures within 3 business days from the date it received full or partial payment. In doing so, the Mall shall take appropriate measures so the User can check the progress of the supply process.
② The Mall shall specify, for Goods purchased by the User, the means of delivery, who bears the cost for each means, and the delivery period for each means. If the Mall exceeds the agreed delivery period, it shall compensate the User for resulting damage, unless the Mall proves that it was not intentional or negligent.
Article 14 (Refund)
If the Mall is unable to deliver or provide Goods, etc. that a User applied to purchase because they are out of stock or for another reason, the Mall shall notify the User of the reason without delay, and if it has already received payment for the Goods, etc. in advance, shall refund the payment, or take the measures necessary to refund it, within 3 business days from the date of receiving the payment.
Article 15 (Withdrawal of Subscription, Etc.)
① A User who has entered into a contract for the purchase of Goods, etc. with the Mall may withdraw the offer to purchase within 7 days from the date of receiving the written contract document referred to in Article 13, paragraph 2 of the Act on the Consumer Protection in Electronic Commerce, Etc. (or, if the Goods, etc. are supplied later than that document is received, from the date the Goods, etc. are received or the date supply of the Goods, etc. begins). However, where the Act on the Consumer Protection in Electronic Commerce, Etc. provides otherwise with respect to withdrawal, that Act governs.
② A User may not return or exchange Goods, etc. after receiving them if any of the following applies:
- The Goods, etc. were lost or damaged for a reason attributable to the User (provided that if packaging, etc. was damaged solely to check the contents of the Goods, etc., withdrawal is still permitted).
- The value of the Goods, etc. has significantly decreased due to the User's use or partial consumption.
- The value of the Goods, etc. has significantly decreased, due to the passage of time, to the point that resale would be difficult.
- In the case of Goods, etc. that are reproducible in an item of the same performance, the packaging of the original Goods, etc. has been damaged.
③ In the cases under paragraph 2, items 2 through 4, if the Mall did not, in advance, clearly mark the fact that withdrawal is restricted in a place where consumers can easily see it, or take measures such as providing a trial product, the User's right of withdrawal is not restricted.
④ Notwithstanding paragraphs 1 and 2, if the content of the Goods, etc. differs from what was indicated or advertised, or was performed differently from the contract, the User may exercise the right of withdrawal within 3 months from the date of receiving the Goods, etc., or within 30 days from the date the User became aware, or could have become aware, of that fact.
Article 16 (Effects of Withdrawal of Subscription, Etc.)
① Upon receiving the returned Goods, etc. from the User, the Mall shall refund the payment already received for the Goods, etc. within 3 business days. If the Mall delays the refund to the User, it shall pay delay interest for the period of delay, calculated using the delay interest rate prescribed in Article 21-2 of the Enforcement Decree of the Act on the Consumer Protection in Electronic Commerce, Etc.
② In refunding the payment, if the User paid for the Goods, etc. by credit card or another electronic payment method, the Mall shall, without delay, request the business operator that provided that payment method to suspend or cancel billing for the Goods, etc.
③ In the case of withdrawal of subscription, etc., the cost necessary to return the supplied Goods, etc. is borne by the User. The Mall shall not charge the User a penalty or claim damages on account of the withdrawal. However, if withdrawal is exercised because the content of the Goods, etc. differed from what was indicated or advertised, or was performed differently from the contract, the cost necessary to return the Goods, etc. is borne by the Mall.
④ Where a User bore the shipping cost when receiving the Goods, etc., the Mall shall clearly and understandably indicate, at the time of withdrawal, who bears that cost.
Article 17 (Protection of Personal Information)
① When collecting a User's personal information, the Mall collects the minimum personal information necessary to provide the Service.
② The Mall does not collect information necessary for performance of the purchase contract in advance at the time of membership registration. This does not apply where the Mall must verify identity, before formation of the purchase contract, to fulfill an obligation under relevant statutes, and collects the minimum specific personal information necessary for that purpose.
③ When the Mall collects or uses a User's personal information, it shall notify the User of the purpose and obtain consent.
④ The Mall may not use collected personal information for a purpose other than the stated one; where a new purpose of use arises or the information is to be provided to a third party, the Mall shall, at the stage of use or provision, notify the relevant User of the purpose and obtain consent. However, this does not apply where relevant statutes provide otherwise.
⑤ Where the Mall must obtain a User's consent under paragraphs 2 and 3, it shall specify or notify in advance the matters set out in Article 22, paragraph 2 of the Act on Promotion of Information and Communications Network Utilization and Information Protection, Etc. — including the identity of the personal information protection officer (affiliation, name, telephone number, and other contact details), the purpose of collection and use of the information, and matters relating to provision of information to third parties (recipient, purpose of provision, and content of the information to be provided) — and the User may withdraw this consent at any time.
⑥ A User may, at any time, request to review and correct errors in their own personal information held by the Mall, and the Mall is obligated to take the necessary action without delay. Where a User has requested correction of an error, the Mall shall not use the relevant personal information until the error has been corrected.
⑦ To protect personal information, the Mall shall keep to a minimum the number of persons who handle Users' personal information, and shall bear full responsibility for any damage a User suffers due to the loss, theft, leakage, unauthorized provision to third parties, or alteration of the User's personal information, including credit card and bank account information.
⑧ The Mall, or a third party that has received personal information from the Mall, shall destroy the relevant personal information without delay once the purpose of collection or the purpose for which it was provided has been achieved.
⑨ The Mall shall not set consent checkboxes relating to the collection, use, or provision of personal information as pre-selected by default. The Mall shall also specifically state which Services would be restricted if a User declines consent to the collection, use, or provision of personal information, and shall not restrict or refuse to provide a Service, such as membership registration, on the ground that a User declined consent regarding personal information that is not a required collection item.
Article 18 (Obligations of the Mall)
① The Mall shall not engage in conduct prohibited by law or these Terms or contrary to public order and morals, and shall use its best efforts to provide Goods and Services continuously and stably as set out in these Terms.
② The Mall shall maintain a security system to protect Users' personal information (including credit information) so that Users can use the internet Service safely.
③ If a User suffers damage because the Mall engaged in unfair labeling or advertising regarding Goods or Services, as prohibited under Article 3 of the Act on Fair Labeling and Advertising, the Mall shall be liable to compensate for that damage.
④ The Mall shall not send commercial advertising e-mail for profit that a User does not want.
Article 19 (Members' Obligations Regarding ID and Password)
① Except in the case under Article 17, responsibility for managing a Member's ID and password rests with the Member.
② A Member shall not allow a third party to use their ID or password.
③ If a Member becomes aware that their ID or password has been stolen or is being used by a third party, the Member shall immediately notify the Mall and follow the Mall's instructions, if any.
Article 20 (Obligations of Users)
Users shall not engage in any of the following:
- Registering false information when applying for or changing information
- Misappropriating another person's information
- Altering information posted on the Mall
- Transmitting or posting information (such as computer programs) other than information designated by the Mall
- Infringing the copyright or other intellectual property rights of the Mall or third parties
- Damaging the reputation of, or interfering with the business of, the Mall or third parties
- Disclosing or posting on the Mall obscene or violent messages, images, audio, or other information contrary to public order and morals
Article 21 (Relationship Between a Linking Mall and a Linked Mall)
① Where an upper-level "Mall" and a lower-level "Mall" are connected by a hyperlink (a hyperlink target may include text, images, or video), the former is referred to as the "linking Mall" (website) and the latter as the "linked Mall" (website).
② Where the linking Mall has clearly stated, on its initial screen or in a pop-up screen appearing at the time of linking, that it does not warrant transactions a User conducts based on Goods, etc. independently offered by the linked Mall, the linking Mall bears no warranty responsibility for that transaction.
Article 22 (Ownership and Restriction of Use of Copyright)
① Copyright and other intellectual property rights in works created by the Mall belong to the Mall.
② A User shall not use, for commercial purposes, or allow a third party to use, information obtained through use of the Mall in which intellectual property rights belong to the Mall, by means of reproduction, transmission, publication, distribution, broadcasting, or otherwise, without the Mall's prior consent.
③ Where the Mall uses copyright belonging to a User by agreement, it shall notify the relevant User.
Article 23 (Dispute Resolution)
① The Mall shall establish and operate a grievance-handling mechanism to reflect legitimate opinions or complaints raised by Users and to provide compensation for any resulting harm.
② The Mall shall give priority to handling complaints and opinions submitted by Users. Where prompt handling is difficult, the Mall shall immediately notify the User of the reason and the expected schedule for handling the matter.
③ Where a User applies for relief in connection with an e-commerce dispute arising between the Mall and the User, the matter may be submitted to mediation by the Fair Trade Commission or a dispute mediation body commissioned by a City Mayor or Provincial Governor.
Article 24 (Jurisdiction and Governing Law)
① Litigation concerning an e-commerce dispute arising between the Mall and a User shall be subject to the exclusive jurisdiction of the district court having jurisdiction over the User's address at the time the action is filed, or, if there is no such address, the User's place of residence. However, if the User's address or place of residence is not clear at the time the action is filed, or if the User resides abroad, jurisdiction shall be determined under the Civil Procedure Act.
② Korean law shall apply to e-commerce litigation brought between the Mall and a User.
These Terms take effect on September 6, 2026.
